Speeding ticket

The actual cost of a speeding ticket in Ontario can be much more than the fine on the ticket. Insurance companies are always looking at the risk for any insurance policy holder.

  • Each speeding ticket has a fine: the faster the speed the higher the fine.
  • All Speeding tickets for more than 15km/h over the speed limit have demerit points.
  • Speeding tickets for more than 50km/h over the speed limit, the prosecutor can ask that your driver’s license be suspended for at least thirty (30 days).
  • For G1 and G2 drivers or drivers with a graduated driver’s license, speeding tickets with four (4) demerit points have a 30 day license suspension.
  • Speeding Tickets affect your insurance.
Careless driving

Even one conviction for careless driving can result in an increase in your insurance rates, or worse, you may be identified as “high risk driver”.

Careless driving is a charge that is most often given to someone who has been involved in a collision. It is a very broad charge that covers a wide array of driving situations. A brief description of the charge is “driving a motor vehicle without due care and attention, or without a reasonable consideration for other people using the highway”. Retaining legal representation for a careless driving charge is imperative. The penalties for this offence are quite severe if you plead guilty.
The penalties for a careless driving conviction are as follows:

  • Six demerit points
  • Minimum fine of $400 and no more than $2,000
  • Possible suspension of your driver’s license for a period of no more than two years
  • Possible term of imprisonment for up to six months

Should we be unsuccessful in eliminating the charges, we will work to reduce the charge and minimize the impact on you. We will help you to avoid having your license suspended, protect you from demerit points, and negotiate the lowest possible fine. In extreme cases, we will work to keep you out of jail.

Stunt driving or racing

What are the consequences associated with a stunt driving / street racing conviction?

  • A minimum fine of $2000 up to a maximum fine of $10,000
  • Imprisonment for not more than 6 months
  • License suspension for not more than 2 years for a 1st conviction (up to 10 years for a 2nd conviction)
  • Up to a 100% insurance rate increase for the next three years
  • Six demerit points

First, we will aim to have your charge dismissed. If a dismissal is not possible upon reviewing the evidence, We will work on your case, will negotiate with the prosecutor to have your stunt driving or street racing charge reduced to a minor (and therefore less serious) offence. Depending on the circumstance of your particular stunt driving / street racing charge, a Charter Application arguing against the constitutionality of the offence will be filed.

Red Light Offences

Before you pay a red light ticket, make sure you know exactly what the penalties against you are. Not only do red light infractions carry a fine amount, but also will likely carry 3 demerit points and can increase your insurance rates. There are two types of red light infractions: red light ticket given by a police officer and red light camera tickets.

Red Light Infractions Given by a Police Officer

Red light infractions given by a police officer have both a fine amount to be paid along with 3 demerit points. When you receive a red light ticket from an officer you will have three options:

  • Pleading guilty
  • Pleading guilty with an explanation
  • Trial / not guilty

If you pay a red light ticket you are automatically pleading guilty to the charge and will have to pay the fine along with receiving 3 demerit points on your record which will likely increase your insurance. A plea of guilt with an explanation is not a trial and your ticket will not be eliminated off of your record with this option. The trial option is the only way to fight for dismissal of the ticket or for a drastic reduction in the fine or demerit points.

Red Light Camera Tickets

Red light camera tickets are not given by a police officer, but are mailed to the owner of the vehicle. These tickets have a larger fine amount attached to them, but no demerit points. Since the red light camera does not know who is driving the car and does not provide driver’s license information, demerit points and a conviction against a specific person is not possible. The owner of the car is responsible for paying the fine, but the ticket will not appear on their driver’s record nor will they receive any demerit points for the offence. There is no point in fighting a red light camera ticket in court since it does not register on your record. However, the fine does need to be paid since the owner of the car may have their permit validation refused or may be refused a new permit if the fine is outstanding.

Stop sign traffic ticket

When you receive a stop sign ticket you will have three options:

  • Pleading guilty
  • Pleading guilty with an explanation
